In England it is against the law for anyone to have sex or any sexual activity with a person under the age of 16. The age of consent is the same for any gender or sexual orientation, i.e. homosexuality.

The Sexual Offences Act 2003 provides specific legal protection for those who cannot legally give their consent to any form of sexual activity. There is a maximum sentence of life imprisonment for rape, assault by penetration or inciting a child to engage in sexual activity.

What is meant by sex and sexual activity?

Sex includes vaginal, anal and oral. Sexual activity includes touching genital or mutual masturbation.

Both people are teenagers

In England, Home Office guidance is clear that there is no intention to prosecute teenagers under the age of 16 where both mutually agree and where they are of a similar age.

People in a position of trust

In England it is against the law for a person aged 18 or more to have any sexual activity with a person under the age of 18 if the older person is in a position of trust, such as a teacher or social worker.
